Terms of Service

These Terms of Service ("Terms") govern your use of the Medbed mobile application ("App") and the website at empathmed.in ("Website"), collectively referred to as the "Platform," operated by EmpathMed Solutions Pvt. Ltd. ("Company", "we", "us"), a company incorporated under the laws of India (CIN: U62013MH2024PTC427092), with its registered office in Maharashtra, India.

By downloading, installing, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Nature of the Platform

Medbed is a healthcare information and hospital discovery platform. It helps users find hospitals, view facility availability, and connect with healthcare providers. The Platform uses artificial intelligence to assist users in describing their needs and matching them with appropriate hospitals.

2. Eligibility

You must be at least 18 years of age to use the Platform independently. Individuals under 18 may use the Platform under the supervision of a parent or legal guardian. By using the Platform, you represent that you meet these eligibility requirements.

3. User Accounts

Patients: The Platform does not require patients to create personal accounts. An anonymous device identifier is generated on your device for session management. No personal information such as name, email, phone number, or government ID is collected from patients.

Hospital Administrators: Hospital staff access the Platform through administrator accounts created during the onboarding process. Administrators are responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their accounts.

4. Platform Services

The Platform provides the following services:

• Hospital Discovery: Location-based search and AI-assisted matching of users to nearby hospitals based on symptoms, required facilities, government schemes, and insurance acceptance.
• Information Display: Real-time hospital bed availability, facility listings, accepted government schemes and insurance providers, and hospital contact information.
• Booking Facilitation: In-patient (IPD) and out-patient (OPD) booking requests transmitted to hospitals for confirmation. Booking confirmation is at the sole discretion of the receiving hospital.
• Hospital Management Tools: Dashboard for hospital administrators to manage bed availability, respond to booking requests, manage doctor schedules, and view analytics.

5. AI-Assisted Features

The Platform uses artificial intelligence to process user-described symptoms and match them with appropriate hospitals. You acknowledge and agree that:

• AI-generated responses are informational and do not constitute medical advice or diagnosis.
• The AI may produce inaccurate, incomplete, or inappropriate responses despite best efforts to ensure quality.
• You should always consult a qualified healthcare professional for medical decisions.
• Triage classifications generated by the AI are used internally for hospital routing and are not clinical assessments.

6. Hospital Information

Hospital information displayed on the Platform, including contact numbers, facility listings, bed availability, and accepted schemes/insurances, is sourced from:

• Publicly available government health directories and portals
• Information voluntarily provided by hospitals during onboarding
• Data updated by hospital administrators through the Platform

We make reasonable efforts to ensure the accuracy of this information but do not guarantee it. Hospital information, including availability and pricing, may change without notice. We recommend contacting the hospital directly to confirm details before visiting.

Hospitals may request removal or correction of their information by contacting us at support@empathmed.in.

7. Booking Terms

• A booking request submitted through the Platform is a request, not a confirmed appointment. The hospital may accept or decline the request at their discretion.
• Booking confirmation, scheduling, and any associated fees are determined entirely by the receiving hospital. The Company does not set, control, or guarantee hospital fees.
• The Company acts solely as an intermediary to transmit booking requests and does not enter into any patient-hospital service agreement.
• Cancellation policies are governed by the respective hospital's terms. In the current version, patients may contact the hospital directly to cancel bookings.

8. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law or regulation
• Transmit false, misleading, or fraudulent information (including fabricated symptoms or identity)
• Attempt to gain unauthorized access to hospital administrator accounts or Platform infrastructure
• Interfere with or disrupt the Platform's operation, servers, or networks
• Scrape, copy, or extract data from the Platform by automated means without prior written consent
• Use the Platform to harass, threaten, or cause harm to any person or entity
• Impersonate any person, hospital, or entity

9. Intellectual Property

The Platform, including its design, code, content, branding (including the "Medbed" name and logo), and AI models, is the property of EmpathMed Solutions Pvt. Ltd. and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without prior written consent.

10. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Platform, you consent to the practices described in the Privacy Policy.

We are committed to compliance with the Digital Personal Data Protection Act, 2023 (DPDP Act) and other applicable data protection laws in India.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
• The Company does not guarantee the accuracy, completeness, or timeliness of hospital information, bed availability data, or AI-generated recommendations.
• The Company shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.
• The Company is not responsible for the quality of healthcare services provided by hospitals listed on the Platform. Any disputes regarding treatment, billing, or services are between the patient and the hospital.
• The Company's total liability for any claim arising from these Terms shall not exceed the amount paid by you to the Company in the twelve (12) months preceding the claim, or INR 1,000, whichever is lower.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any rights of a third party.

13. Third-Party Services

The Platform may integrate with or link to third-party services, including but not limited to map and navigation services, payment processors (in future versions), and insurance providers. These services are governed by their own terms and privacy policies. The Company is not responsible for the availability, accuracy, or practices of third-party services.

14. Modifications to the Platform and Terms

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice. We may update these Terms from time to time. The updated Terms will be posted on this page with a revised effective date. Continued use of the Platform after any changes constitutes acceptance of the modified Terms.

15. Termination

We may terminate or suspend your access to the Platform at any time, with or without cause, and without prior notice. Hospital administrator accounts may be deactivated for violation of these Terms or the applicable onboarding agreement.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Nagpur, Maharashtra, India.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
