Terms of Service

These Terms of Service ("Terms") govern your use of the Medbed mobile application ("App") and the website at empathmed.in ("Website"), collectively referred to as the "Platform," operated by EmpathMed Solutions Pvt. Ltd. ("Company", "we", "us"), a company incorporated under the laws of India (CIN: U62013MH2024PTC427092), with its registered office in Maharashtra, India.

By downloading, installing, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Nature of the Platform

Medbed is a healthcare information and hospital discovery platform. It helps users find hospitals, view facility availability, and connect with healthcare providers. The Platform uses artificial intelligence to assist users in describing their needs and matching them with appropriate hospitals.

Important: Medbed is not a medical device, does not provide medical diagnoses, and is not a substitute for professional medical advice, examination, or treatment. In a medical emergency, call 108 or visit your nearest emergency room immediately. Do not rely solely on this Platform for emergency medical decisions.

2. Eligibility

You must be at least 18 years of age to use the Platform independently. Individuals under 18 may use the Platform under the supervision of a parent or legal guardian. By using the Platform, you represent that you meet these eligibility requirements.

3. User Accounts

Patients: The Platform does not require patients to create personal accounts. An anonymous device identifier is generated on your device for session management. No personal information such as name, email, phone number, or government ID is collected from patients.

Hospital Administrators: Hospital staff access the Platform through administrator accounts created during the onboarding process. Administrators are responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their accounts.

The Platform, including its design, code, content, branding (including the "Medbed" name and logo), and AI models, is the property of EmpathMed Solutions Pvt. Ltd. and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without prior written consent.

10. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Platform, you consent to the practices described in the Privacy Policy.

We are committed to compliance with the Digital Personal Data Protection Act, 2023 (DPDP Act) and other applicable data protection laws in India.

The Platform may integrate with or link to third-party services, including but not limited to map and navigation services, payment processors (in future versions), and insurance providers. These services are governed by their own terms and privacy policies. The Company is not responsible for the availability, accuracy, or practices of third-party services.

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice. We may update these Terms from time to time. The updated Terms will be posted on this page with a revised effective date. Continued use of the Platform after any changes constitutes acceptance of the modified Terms.

15. Termination

We may terminate or suspend your access to the Platform at any time, with or without cause, and without prior notice. Hospital administrator accounts may be deactivated for violation of these Terms or the applicable onboarding agreement.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Nagpur, Maharashtra, India.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
